License to use the AndroidTM Application 

By downloading the Application, you accept to be bound by the following terms and conditions.

 

SCOPE OF LICENSE

The right to use the Application is granted to you by Loto-Québec and its subsidiaries (‘Loto-Québec’) under license. The Application is not sold to you. This license to use the Application (‘License’) governs the content and operation of Loto-Québec’s Lotteries of Loto-Québec Application (‘Application’), as well as each person’s authorized use of the Application.
Loto-Québec reserves all rights not expressly granted to you.
The Application is non-transferable and you are allowed to use it only on devices that you own or control (‘Device’). You may not distribute or make the Application available over a network where it could be used by multiple devices at the same time. You may not lease, transfer, lend or sublicense the Application. You must delete the Application from your Device before you sell or otherwise transfer your Device.

 

MODIFICATIONS

You accept that the License may be modified by Loto-Québec at any time without prior notice and that you are bound by these modifications. Therefore, it is recommended that you consult this License regularly in order to remain apprised of the applicable terms and conditions. The License will govern any upgrades provided by Loto-Québec that replace and/or supplement the original Application, unless such upgrade is accompanied by a separate license in which case the terms of that license will govern.

 

SERVICES OFFERED

The Application requires an Internet connection. It is exclusively reserved to users aged 18 years or over and is limited to the province of Québec. It can only be used if location services are enabled.

Subject to compliance with the License and the Specific Online Gaming Conditions of Use, the Application allows you to:

  1. verify your terminal-issued tickets;
  2. consult draw results for different lotteries;
  3. receive, at your request, notifications on upcoming jackpots of certain lotteries;
  4. create a lottery group or join an existing group;
  5. prepare and save your selections or your play in order to generate a bar code. The bar code appearing on your Device screen is not an official Loto-Québec lottery ticket. You must go to a Loto-Québec retailer and present the bar code appearing on your Device screen in order to have your selection registered and your lottery ticket issued by the retailer;
  6. register on Loto-Québec’s online gaming site and create an Espacejeux account;
  7. if you have an Espacejeux account:
    1. open a gaming session in order to conduct a transaction in your Espacejeux account and proceed with the online purchase of your selection or your play. Once the transaction has been successfully completed, your selection or your play will be registered by Loto-Québec’s central computer system;
    2. deposit Argent Web coupons;
    3. receive prizes that you have won, which are paid directly into your Espacejeux account, in accordance with the Specific Online Gaming Conditions of Use.

The content and operation of the lotoquebec.com website are governed by the Specific Online Gaming Conditions of Use, which apply in addition to the License. In the event of a discrepancy between a condition stated in the License and a condition stated in the Specific Online Gaming Conditions of Use, the latter shall prevail.

Only selections and plays registered by Loto-Québec’s central computer system participate in the corresponding draws.

In the event of a disparity between the results indicated in the Application and those of Loto-Québec’s official winning list, the latter shall prevail.

The various lotteries are governed by the By-law respecting forecast contests and number games or the Regulation respecting the Mini Loto, Inter Loto, any instant lottery and any “pool” type lottery, which include limitations of liability, as well as by the game rules of each lottery. FINGERPRINT LOGIN TO ESPACEJEUX ACCOUNT.

One of the functionalities of the Application is to allow you to login to your Espacejeux account using you fingerprint instead of your username and password.

This functionality is optional and you may turn it off at any time.

Your username and password remain valid and, if you turn off the functionality, you will be able to use your username and password to login to your Espacejeux account.

The functionality is only available if your Device supports fingerprint authentication.

To do so, you must turn on and set up the functionality on your Device. You will then be able to associate your fingerprint to your Espacejeux account.

As long as the functionality is turned on, your fingerprint, enrolled in your Device settings, can be used as a personal identification code to access your Espacejeux account.

You are solely responsible for preserving the confidentiality of your personal identification code, as specified in the Specific Online Gaming Conditions of Use.

All fingerprints enrolled in your Device settings can be used to login to your Espacejeux account. You are solely responsible for ensuring that only your own fingerprint is enrolled and associated to your Espacejeux account.

Loto-Québec does not store any images or other data regarding your fingerprint.

 

THIRD PARTY SERVICES

The Application may enable access to Loto-Québec’s and/or third parties’ web sites and services. Use of these services may require Internet access and that you accept additional terms of service.

 

PROMOTIONS

Promotions that Loto-Québec may choose to offer (for example, draws or promotional tournaments) are governed by the Sales promotion games By-law, which includes limitations of liability.

ELIGIBILITY

By downloading the Application, you confirm to Loto-Québec that you are aged 18 years or older.

 

PRIVACY

Loto-Québec is committed to complying with its Policy Concerning Privacy and the Protection of Personal Information (https://societe.lotoquebec.com/en/privacy)

Loto-Québec reserves the right to publish the name, city of residence and photograph of all winners, including in social media such as Facebook, Twitter and YouTube.

The Application does not include any technology that could be used to collect your personal information without your consent. Some information is exchanged automatically between your Device and Loto-Québec's and third parties’ servers. In addition, your Device ID is recorded and stored when you request to receive notifications. This information in no way identifies you personally.

Loto-Québec uses Google Analytics in the Application. In accordance with the overall conditions, Loto-Québec is required to inform the User of how the information will be utilized. For further details, consult Google’s Privacy Policy and Terms of Service.

LIMITATION OF LIABILITY

Loto-Québec offers no guarantee whatsoever with regards to the Application and you agree to download and use the Application as is and at your own risk.

In addition to the other limitations of liability contained herein or in any other applicable text, Loto-Québec and its subsidiaries, their administrators, employees or agents shall not be held in any way responsible under civil law or otherwise for any losses or damages of any kind whatsoever, including loss of data or damages to your Device, related to the download or use of the Application, including browsing any Internet site linked to the Application by hyperlink or otherwise, or the inability to access or use the Application, including in case of:

  1. failure or defect of the Application or failure, defect or destruction of information systems used in relation with the Application;
  2. delays or lateness, however caused, which preclude anyone from accessing or consulting the draw results or requested notifications, accessing or using an Espacejeux account, completing an online purchase or having a selection or a play registered or having a lottery ticket issued, in a timely manner;
  3. errors, omissions, inaccurate or outdated information presented in the Application;
  4. the consequences of any harmful programming code that could install itself in the Application or be transmitted via the Application; or
  5. failure, delay or other like circumstances attributable to third parties involved in the provision of services, including suppliers of telecommunication services or equipment.

You understand and agree that Loto-Québec may, at any time and at its sole discretion, cease to offer the Application, withdraw, update or modify it, without incurring any liability on its part. Moreover, Loto-Québec shall not be held liable if it decides to decline, deactivate, block, suspend or terminate your right to use the Application or take any other measure it deems appropriate due to non-respect of the License or for any other reason it deems relevant, and may proceed to any verification of any disputed or suspicious situations.

 

INTELLECTUAL PROPERTY

Certain names, words, titles, expressions, logos, icons, graphic elements, drawings and diagrams or other content appearing in the Application are commercial designations or trademarks held by Loto-Québec, or commercial designations or trademarks granted to it by virtue of a license. All other material contained in the Application is also protected by copyright.

The unauthorized downloading, retransmission, copying or modification of trademarks, images, text or data contained in the Application may contravene federal or provincial laws, and especially the laws pertaining to patents, trademarks, industrial drawings or copyright.

Except for the purposes of using the Application, or unless otherwise indicated, it is strictly prohibited to copy, redistribute, reproduce, republish, store on any medium, retransmit or modify the information contained in the Application, or to make public or commercial use thereof in any way whatsoever.

You may not decompile, reverse engineer, disassemble, attempt to derive the source code of, or create derivative works of the Application, any updates, or any part thereof.

Any attempt to do so is a violation of Loto-Québec’s rights and may be subject to prosecution.

 

TERMINATION

The license is effective until terminated by you or by Loto-Québec. Your rights under the License will terminate automatically without notice from Loto-Québec if you fail to comply with any term(s) of the License. Upon termination of the License, you shall cease all use of the Application, and destroy all copies of the Application.

 

LANGUAGE

In the event of a discrepancy between the French and English versions of the License, the French version shall prevail.

 

JURISDICTION

In the event that the download or use of the Application results in any conflict, such conflict must be resolved in accordance with the laws applicable in Quebec and in Canada before a Montreal district court.
